Human rights organizations such as Israel Genocide Tracker / @trackingisrael on X have exacerbated these risks by compiling "blacklists" of IDF soldiers based on footage they post online. These organizations actively monitor social media to track the movements of soldiers and file legal complaints when they travel abroad. Soldiers are now advised to avoid disclosing their locations during vacations to evade surveillance and legal action. While Israel retains jurisdiction over its military personnel, the ICC may prioritize prosecuting senior officers, heightening concerns within the security and legal establishments.
The recent issuance of arrest warrants by the International Criminal Court (ICC) in The Hague for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant has escalated legal risks for Israel Defense Forces (IDF) personnel abroad. The ICC’s actions may lead to increased criminal proceedings against both senior officers and rank-and-file soldiers who participated in operations in Gaza. The IDF has reported at least 30 such cases, with eight soldiers urgently leaving countries like Cyprus and the Netherlands to avoid potential prosecution. These developments have prompted the IDF to implement a risk assessment policy for soldiers seeking to travel overseas, prioritizing the safety of combat soldiers and commanders.
Israel has mobilized extensive legal and intelligence resources. Local lawyers in various countries monitor legal developments and represent IDF soldiers if necessary. Additionally, an inter-ministerial team, including representatives from the Mossad and Shin Bet, assesses the likelihood of arrests or interrogations abroad. These efforts include providing immediate legal support to soldiers facing scrutiny, particularly in countries with active ICC involvement.
