RULE OF LAW 2024 Report: Belgium Under Scrutiny

In 2023, out of the 873 individuals required to submit asset declarations, 11 failed to do so.

The Parliament currently has no plans to advance this issue due to concerns related to the privacy of senior executive officials, despite existing GRECO recommendations.

Civil society organizations have criticized the lack of transparency in asset declarations as well as the organization of the system as a whole. Regarding additional mandate declarations, 9,567 out of the 9,609 individuals required by law to submit a mandate declaration in 2023 complied with this requirement, but in the absence of adequate verification, the accuracy of the declaration is solely the individual’s responsibility.

Some criticisms have been expressed about the unclear standard form for presenting information related to these mandates (such as remuneration) and the existing system’s failure to require the declaration of actual conflicts of interest.

A Federal Ethics Commission opinion on the accumulation of public sector positions has not yet been followed up on. Regional processes have also faced criticism for their lack of precision, transparency, controls, and sanctions."

Belgium is criticized for the lack of transparency in the asset declarations of elected officials and for the absence of adequate verification of the accuracy of mandate declarations.Excerpts: "There are still gaps regarding the verification and transparency of asset and interest declarations, with no new measures having been taken. As noted in previous reports on the rule of law, the asset declaration system does not ensure adequate verification and transparency, as the Court of Auditors receives the declarations in sealed envelopes, and only investigating judges have access to them in the context of criminal investigations.
